Ensure Your Building Is NDAA Compliant

Those of us in the security space are probably well aware of the John S. McCain National Defense Authorization Act (NDAA) for Fiscal Year 2019, which prohibits the U.S. government from procuring video and telecommunication equipment from certain Chinese companies and their subsidiaries. This act specifically bans security cameras by Hikvision, Dahua, and their OEMs. It also requires all federal government and “critical infrastructure” to remove any product that originated in a Hikvision or Dahua factory before Aug 1, 2019.

Why were these brands banned for federal government use?

The intent behind the ban is to increase electronic and network security in order to protect federal government agencies from the growing risk of mass espionage and hacking.

Does the ban affect only the federal government or local government too?

While the NDAA ban affects federal projects only, many states have discussed complying with bans for state level purchasing and some local governments have passed laws requiring that they follow the same regulations as the NDAA.

Does this ban affect projects other than federal government?

Section 889 of the NDAA applies to schools, healthcare contractors, payers, and providers that accept money from the U.S. government, directly or indirectly, including hospital systems, labs, and research affiliates.

Subsection A of Section 889 prohibits entities from procuring, obtaining, extending, or renewing a contract to procure or obtain equipment that incorporates or services that use technology containing components manufactured by Huawei, ZTE, and three other Chinese entities. This includes video surveillance, video recording, and/or any networking services provided by these vendors. Universities, health systems, or any other entity that currently receives federal funding that chooses not to comply with the NDAA by August of 2020 could risk losing federal grants or funding.

Even if you are not required to be NDAA compliant now, it may make sense to purchase compliant gear to future-proof your building in case additional restrictions on Chinese-made products are introduced.
